The case being brought against Loren Danner by the Carroll Airport Commission for a structure extending 61 feet into protected airspace began today (Tuesday) in Carroll County District Court. In 2013, Danner received a building permit from the county to construct a grain leg, but the Commission alleges Danner is in violation of two ordinances that require approval from them for any object measuring over 30 feet. The case against Danner was first filed in July of 2015 but is just now going to court. Danner attempted to request a variance from the Board of Adjustments last week and was denied. He estimates it would cost over $400,000 for him to bring the grain leg back into compliance. Proceedings for the case also closed Tuesday, but Danner and the Carroll Airport Commission will have to wait six weeks for the judge to decide on the case. A ruling date has been set for May 1.
