Lawsuit Filed Thursday Against Rancho Grande Seeks Damages From May 2017 Accident

A Carroll County woman filed a petition in District Court last week against a local restaurant, seeking damages for injuries sustained in a car accident nearly a year ago. Corie J. Walsh, who filed the claim last Thursday against Rancho Grande, claims that on May 30, 2017, the restaurant knowingly overserved alcohol to Linda Smith, of Coon Rapids, to the point she became intoxicated. Smith later left the establishment and was killed in a collision that also left Walsh injured. Under Iowa’s Dramshop Act, businesses that serve alcohol are liable for injuries caused by people they serve to the point of intoxication. Walsh’s attorney, James Van Dyke, says these cases have a long standing precedent and a high-profile Iowa Dramshop case was recently settled.

Walsh is requesting compensation from the court for medical bills, pain and suffering, lost wages and earning capacity. Carroll Broadcasting has made several attempts to contact Rancho Grande management for comment.
