A trial date has been scheduled for a personal injury case filed against a local Mexican restaurant. The jury trial of Corie Walsh v. Dos Rancheros, Inc., doing business as Rancho Grande, is listed to begin on Sept. 24, 2019 in the Carroll County Courthouse. Proceedings are anticipated to last approximately three days if the case is not settled before that date. Walsh was injured in a two-vehicle collision on May 30, 2017 on Highway 30 with Linda Smith. The petition, filed March 1, seeks compensation for injuries sustained in that accident, medical expenses and resulting loss of earning potential. It states the physical and financial damages Walsh experienced were caused by Smith’s intoxication. In their response to the petition, Dos Rancheros admits to serving alcohol to Smith but denies overserving her. Under Iowa’s dram shop law, businesses that serve a customer to the point of intoxication are liable for later damages caused by that individual.
