A new trial date has been scheduled in District Court for Carroll County to settle a dispute between the City of Carroll and a construction company over payments. The estimated three-day trial was originally slated to get underway on Tuesday, Feb. 26 but has been rescheduled to now begin on Oct. 29. Drake Construction, of Menlo, filed their petition in April of last year, claiming the city had failed to pay for work completed on the city’s water supply well and transmission lines that was requested orally beyond the scope of the original contract. They have asked for damages to be awarded to the company due to the city’s alleged breach of both the oral and written contracts. City officials are refuting Drake Construction’s claims and filed a counterclaim in response. They say the City of Carroll suffered damages through delays to the project and experienced additional labor and equipment costs. Their petition asserts Drake Construction was the entity in violation of the contract.
