Negotiations To Settle Dispute Over Grain Leg Protruding Into Protected Airspace At Carroll Airport Hits Stalemate With Insurance Companies

There has still been no decision made by the Iowa Supreme Court on an appeal by Loren and Pan Danner, Carroll County farmers and defendants in a lawsuit brought by the Carroll Airport Commission because of zoning infractions with a grain leg that protrudes about 60 feet into protected airspace. While all parties await the Danner’s appeal after being told they had to lower the leg and pay civil penalties of $200 a day, beginning in May of 2018, Danner approached the commission and the Carroll Supervisors about a possible settlement. In March, Danner and his attorney, Steve Hamilton, made a request that because he had asked for and received the proper permits to build the leg, the county split the cost of lowering it, roughly $100,000. The matter was turned over to the county’s insurance company. The supervisors agreed to pay their deductible and allow the insurance company representatives to negotiate the settlement. Today (Monday), Danner was back before the board because of an apparent stalemate in the process.

Carroll County Auditor, Kourtney Irlbeck, spoke with their local agent and was told that it was out of his hands as well. Supervisor Chair, Neil Bock, says it is now between the insurance company and Danner’s counsel.
