Sac County Swine Operation Owner Is Ordered To Submit Manure Management Plans Along With Penalties For Non-Compliance

A Sac County swine operation owner is being sanctioned by the Iowa Department of Natural Resources (DNR) for not having submitted the proper Manure Management Plans (MMP) after taking over ownership. An Administrative Order from the DNR dated Oct. 18, states that Alberto Tello Castaneda purchased a 1,600 head swine feeding operation on Xavier Avenue, north of Auburn, in September of 2020. He was notified on Dec. 29, 2020 that he needed to submit the MMP by Feb. 28, 2021. To date, the DNR has yet to receive that plan or the associated fees. The DNR Field Office issued a notice on March 19, stating that further enforcement on the issue was being sought. They have now ordered the completion of the original MMP and filing fees to be submitted within 60 days from the date of the order. Castaneda is also subject to the $250 filing fee, a $64 indemnity fee, a $96 compliance fee and an administrative penalty of $3,000.
