Sen. Grassley Says California Bill That Could Impact Iowa Pork Producers Unlikely To Be Upheld By U.S. Supreme Court

Senator Chuck Grassley says many Iowa producers are closely monitoring the U.S. Supreme Court’s decision on a California law that could have wide-ranging impacts on the nation’s $26-billion-per-year pork industry. California’s Proposition 12 would require all pork sold in the state to comply with sow housing space requirements. If the bill is upheld, Grassley says it would force pork producers to follow the rules set by a state that imports nearly all of its pork products.

Interstate commerce has traditionally fallen under the purview of Congress via the Constitution’s Commerce Clause. Oral arguments were presented yesterday (Tuesday) to justices, and Grassley believes it is highly unlikely Proposition 12 will be upheld.

Grassley suggests the most concerning aspect of this case is the blatant attempt to interfere with interstate commerce by a state that has little to do with the industry it is attempting to regulate. Proponents of the bill argue it addresses animal cruelty and reduces the risk of foodborne illness. The U.S. Supreme Court is expected to issue its ruling early next year.
