A Carroll man accused of lottery fraud and felony theft was sentenced to probation last week in Carroll County District Court. According to court records, 33-year-old Cody Jonathan Wolfe reached an agreement with prosecutors earlier this year to plead guilty to second-degree theft, a class D felony, and the lottery fraud count would be dismissed. The charges stem from a Carroll Police Department investigation that found Wolfe had voided numerous transactions and redeemed stolen lottery tickets while employed at Sparky’s One Stop in Carroll between Feb. 1 and April 21 of this year. Thursday, a judge issued an order sentencing Wolfe to up to five years in prison and ordered him to pay nearly $3,500 in victim restitution. However, the prison term and associated fines and surcharges were suspended, and Wolfe was placed on probation to the Iowa Department of Corrections for a period of three years. The prison term, if ever imposed, will be served consecutively with a two-year term handed down in a separate assault case.
