Carroll County Feedlot Operator Fined $2,000 For Failure To Submit Annual MMP Update And Fees

The Iowa Department of Natural Resources (DNR) has fined a Carroll County feedlot operator for failing to submit a complete Iowa Phosphorus Index Manure Management Plan (MMP) and associated fees for his animal feeding operation. The DNR has assessed a $2,000 penalty against Joe Tomka as part of the administrative consent order announced by the DNR yesterday (Thursday). According to state officials, Tomka operates a facility about three miles southeast of Arcadia with a capacity of 825 head of cattle in confinement and 400 head in open feedlots. Despite reminders from DNR staff, Tomka failed to meet the May 1 deadline for submitting the required MMP and fee. Previous violations in 2021, 2022, and 2023 were also noted, leading to this enforcement action. The DNR arrived at the $2,000 total fine by assessing $100 due to economic benefits received from noncompliance, $900 for the impact it had on the animal feeding and operation regulations, and $1,000 for his culpability in the matter. Tomka is required to pay the penalty within 30 days of the order.
