The Iowa Supreme Court has denied a Carroll man’s request to review his 2010 conviction for second-degree sexual abuse. Last month, 30-year-old Jesse Neitzel, who is currently serving a 25-year-sentence at the Iowa Medical and Classification Center in Johnson County, submitted a certiorari petition claiming the case was out of Carroll County District Court jurisdiction due to him being a minor at the time the offense occurred. The state resisted the petition on the grounds applicants must submit such requests within 30 days of the order that is being challenged. Justices agreed with the challenge and denied Neizel’s appeal. In the almost 12 years since the sentence was handed down, Neitzel has appealed on seven occasions, including the original case, five post-conviction relief requests, and the certiorari petition. A jury found Neitzel guilty in 2010 of sexually abusing a seven-year-old girl in 2007 when he was 16 years old. He is required to serve at least 17.5 years of the 25-year sentence. His scheduled release date is July 31, 2031.
