A motion to postpone judgement, filed by a Breda man accused of drug trafficking, was approved earlier this week by a Carroll County District Court Judge. Thirty-five-year-old Andrew Vernon Wempe was formally charged on May 23 with possession with intent to deliver methamphetamine and marijuana, class C and class D felonies. The charges stem from a traffic stop by a Carroll County Sheriff’s Office deputy that located approximately 2.2 grams of methamphetamine, nearly 24 grams of marijuana, a scale and multiple plastic baggies. Wempe reached an agreement with prosecutors on Oct. 1, which stated he would enter a guilty plea to the methamphetamine charge and the remaining count would be dismissed. Before a sentencing hearing could be held, Wempe filed a motion for arrest of judgement, claiming the agreement was not in his best interests and the signed plea agreement was for personal use. His motion was approved on Monday, and as a result, a new trial date has been scheduled for Tuesday, Jan. 15, 2019 at the Carroll County Courthouse. If found guilty of the charges, he faces a maximum sentence of 15 years in prison and more than $17,000 in fines. Wempe was one of two people injured on April 12, the other being 39-year-old Jacob Helkenn of Breda, when 48-year-old Robert John Morris, of Carroll, shot both men in the lower extremities.
